Every 10 years, new Census figures are released and federal, state, and local districts are reviewed and updated across the country. The redistricting and apportionment processes are complex and governed by a litany of competing state and federal laws addressing a wide variety of factors spanning population equality, compactness, contiguity, municipal boundaries, communities of interest, equal protection, minority voting rights, and even partisan fairness. Our attorneys have extensive experience guiding clients through the intricacies of the redistricting process and conducting litigation when necessary. Most recently, on behalf of a group of African-American voters in Detroit, our attorneys successfully prosecuted the landmark case of Agee v. Benson where, after a two-week trial, a federal three-judge panel unanimously struck 13 state house and senate districts drafted by Michigan’s Independent Citizens Redistricting Commission in violation of the Equal Protection Clause of the U.S. Constitution.
