The Clark Hill Environment, Energy & Natural Resources (EENR) group has deep experience in all aspects of the federal and state regulation of pesticides and pesticide devices. These products are heavily regulated by the US Environmental Protection Agency (EPA) and other federal and state agencies under the US Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), Federal Food, Drug, and Cosmetic Act (FFDCA), Food Quality Protection Act (FQPA), and other applicable state and federal laws.
Our attorneys help guide clients through registration, production, marketing, licensing, distribution and sale, and import and export issues. We represent clients in finding ways to resolve complex issues in the registration of ground-breaking and innovative products; addressing a host of labeling compliance issues; negotiating licensing agreements and establishing proper distribution chains; and ensuring compliance with requirements for importing and exporting these products.
When necessary, our attorneys represent clients in responding to agency investigations, defending against potential enforcement actions, and resolving situations where products have been detained by US Customs and Border Patrol (CBP). Our attorneys have experience negotiating favorable civil penalties and navigating issues associated with products subject to Stop, Sale, Use or Removal Orders (SSUROS) and Notices of Detention.
