Our attorneys have counseled communities facing enforcement actions by federal and state governments related to combined sewer overflow systems and sanitary sewer overflows and have successfully negotiated consent agreements with the U.S. Department of Justice (DOJ) and the U.S. Environmental Protection Agency EPA). We have extensive experience negotiating National Pollutant Discharge Elimination System (NPDES) permits as well as preparing legal challenges to permits with unfavorable terms.
We have litigated these issues with federal and state governments and bring the experience of having served in senior positions with the DOJ, EPA, and the U.S. Army Corps of Engineers.
Our attorneys closely monitor all significant developments in wet weather cases across the country and track key issues at EPA and state environmental agencies to be at the forefront of new trends and developments. We also actively participate in several associations involved with major wet weather issues, including the National Association of Clean Water Administrators (NACWA), and frequently speak at conferences on emerging wet weather issues.
Our team also has significant experience with the federal grants process for securing funding for water infrastructure projects as well as compliance with emerging water security laws passed in the wake of the 9/11 terrorist attacks.
