Timothy McGibboney is a corporate healthcare attorney advising on business, regulatory, compliance, reimbursement/billing, and transactional matters. He represents a wide variety of healthcare providers, suppliers, and other healthcare industry businesses. He advises privately held companies, private equity firms, and venture capital groups on their investments in the healthcare industry, including due diligence reviews of target acquisitions, negotiated contracts, and ongoing regulatory compliance advice related to investments.

Tim represents companies including hospitals, health systems, physician practices, clinical trial healthcare management organizations, clinical laboratories, telehealth providers, digital health business, medical device manufacturers/distributors, managed care plans, and other healthcare organizations on virtually all aspects of healthcare law. Tim also acts as general counsel to non-healthcare businesses in managing legal needs.

Fraud & Abuse Compliance. Tim brings deep experience advising clients on the federal Anti-Kickback Statute (AKS), the Physician Self-Referral Law (Stark Law), the False Claims Act (FCA), and related state laws. He works closely with healthcare organizations to structure ownership, financial, and referral arrangements that align with both regulatory requirements and business strategy. He also represents clients in government audits, investigations, and enforcement actions—both civil and criminal.

Mergers & Acquisitions | Commercial Transactions. Tim advises emerging and established healthcare companies on mergers and acquisitions, private securities offerings, joint ventures, and corporate governance. He regularly negotiates and drafts employment, vendor, marketing, and service agreements, helping clients navigate complex transactions with a clear focus on legal integrity and operational efficiency.

Healthcare Regulatory & Compliance Programs. Tim helps healthcare organizations design and implement practical, scalable compliance programs. His work includes conducting risk assessments, drafting policies and procedures, leading internal reviews, and delivering training to boards, executives, and staff on federal and state health care regulations.

Licensure, Accreditation & Government Oversight. Tim advises providers and suppliers on licensure, registration, and accreditation requirements at both the state and federal levels. He supports clients in responding to surveys, inspections, and investigations by government agencies and accrediting bodies, and advocates for clients in administrative enforcement proceedings.

Credentialing, Reimbursement & Payor Disputes. Tim counsels clients on credentialing and enrollment, reimbursement policies, managed care contracting, billing compliance, and medical necessity determinations. He represents healthcare providers and suppliers in connection with audits, overpayment disputes, recoupments, and related commercial payor litigation.
