Roy Goldberg is a litigator and regulatory lawyer whose principal area of practice is the aviation industry.  He represents airlines, airports, fixed-base operators, charter companies, helicopter companies, and other aviation industry entities in regulatory and litigation matters.

Roy uses federal preemption to get cases against airlines dismissed before discovery is required and to help ensure that airports comply with federal grant assurance obligations. His cases have involved successful airline challenges to airport rates and charges, and defending airports against legal claims based on noise and environmental issues.

Roy also defends airlines in class actions and against claims under the antitrust laws, RICO, and various federal and state laws.

Roy represents airlines and other aeronautical entities in defense of antitrust, RICO, breach of contract, tort and other legal claims.  He also pursues judicial and administrative challenges to government rates, charges, fees and taxes imposed on airlines and other aviation entities.  Roy also defends airports in litigation involving noise and other environmental issues.

Recently, Roy successfully represented airlines in nearly a dozen cases in which the airlines obtained dismissal of claims raised by persons who challenged airline compliance with the Federal Transportation Mask Mandate during the pandemic.  Roy also successfully defended several airlines which were sued in multiple federal cases because of their collection of the Mexican Tourism Tax from passengers exempt from the tax.

Roy has successfully pursued Part 16 cases to enforce airport “Grant Assurance” obligations.  Roy also successfully challenged billions of dollars in new terminal building rates and charges imposed by Los Angeles at LAX, and led the team which obtained the transfer of Ontario International Airport from Los Angeles World Airports.

Roy represented a major airline in connection with a DOT investigation of a significant operations disruption.  And in three separate cases Roy successfully challenged overflight fees imposed by the FAA on flights that do not take off or land in the United States but utilize FAA air traffic control services.

Roy represents domestic industries in pursuing antidumping and countervailing duty cases against imports from foreign countries.

Roy is the liaison between the American Bar Association (ABA) and its Air and Space Law Forum and was President of the International Aviation Club in Washington, D.C. from 2020 to 2021.
