- corporate and asset transactions: evaluating legal environmental risk and negotiating solutions to manage historic and future environmental liability;
- new business establishment and inward/cross-border investment: guiding clients seamlessly through the development consent, environmental licensing and public participation processes;
- Environmental controversies and contentious matters: proactively identifying and implementing a tailored/targeted approach, whether robust defense, mediation, arbitration or negotiated settlement;
- Protecting clients’ interests in EPA regulatory investigations and incident response; and
- Major project development: here, working closely with clients’ environmental impact assessment and planning and design teams to remove risk of third party procedural or merits-based challenges.
Conor has advised a diverse range of clients on many issues related to the wider environmental finance and pricing regime, including:
- the application of the EU Emissions Trading System to heavy industry, energy, aviation and shipping;
- negotiating environmental financial security instruments for clients ( pollution impairment insurance, performance bonds, parent company guarantees and funding and drawdown agreements); and
- assisting clients to understand, design and implement their Environmental Social & Governance (ESG) and sustainability agendas, including the latest EU measures on environmental and climate-related due diligence, disclosure and reporting.
He places a high value on understanding each clients site, operations and logistics.
